The Protection of Minor under the Unfair Competition Law: Comparative Study of German Act against Unfair Competition, Eu Directives and Fair Trade Act of Taiwan

Project: Research project

Project Details

Description

The minor as a counterpart in transaction is also a participator in the market activities. Due to the physical and metal disadvantage the minor obviously has not sufficient judgment ability as the adult. As the new styles of transaction arise, this kind of physical and metal insufficiency should be bought into considerations in order to prevent him from harm owing to the new technology and transaction style. Therefore the protection of minor under the unfair trade law is an essential topic to research and review. This research will also explore the reason that the minor is harmed from the unfair competition practices. This will be helpful to decide the legal and illegal criteria in each commercial practice and indicate the roll that the age plays in these criteria. The special provisions to protect of the minor in the EU 2005/29 Unfair Commercial Practices Directive and in the recently reversed German Act against Unfair Competition are examined in this research.
