To make the student able to pursue their self-development, and not affected by the different conditions or the background to reach the equal educational opportunity are the purpose of education under multicultural education theory. To make students develop their personalities in a free environment and not to be interfered for achieve their self-actualization is what fundamental right of education in constitution protect. The new immigrant children in Taiwan are getting into the elementary school and junior and senior high school. They are the important human resources in the future. However, the new immigrant children still have some problems in school because of their special background and the cultural differences between the immigrant student and the native student. Therefore, in order to improve the education of the new immigrant children, this thesis will construct the protection of fundamental right of education of new immigrant children under multicultural education, through the discussion on multicultural education theory and the principle of pluralistic culture in the constitution. By the implement of multicultural education in fundamental right of education in constitution, we can provide a free and pluralistic education environment for the new immigrant children, meanwhile, enhance the ability of understanding and tolerance to the different culture of people in Taiwan.
