宗教團體自治的憲法建構與檢討

Abstract

With the social development and changes, the focus of religious freedom, as a fundamental right, has gradually migrated to collective religious freedom - religious group. The controversy of the draft of the Religious Groups Law is one obvious example. However, after more than 10 years, the controversy of the draft of the Religious Groups Law also reflects the bottleneck of the religious law theory. The religious group autonomy is the most relevant concept related to the rights of religious groups. The thesis attempts to construct the guarantee of the religious group autonomy, and shape a set of test steps to determine the constitutionality of state restrictions. Second, analyze and validate the importance and applied value of religious group autonomy, from the religious law and practice. Finally, review the draft of the Religious Groups Law and some controversy, hoping to denote an effort to religious law and rights protection of religious groups.
