AbstractThe rule of law is a symbol of the modern state, and it requires the public power must abide by the law. However, becoming a rule-of-law state appears to be snail-paced by the impact of traditional thinking and martial law period in Taiwan. After the abolishment of martial law, pursuing a formal rule of law sate is emphasized even though there are voices calling for reformation. Respecting the painful lessons that Germany experienced, the only way to protect the fundamental rights of Taiwanese is to become a material rule-of-law state. In this regard, the implementation of law-related education is a top priority. Unfortunately, the education system in Taiwan has been controlled by the government for a long time, making teachers consider law-related education as crime prevention education. In order to reverse this phenomenon, equipping prospective teachers and serving teachers with the knowledge, attitudes, behaviors and skills of the rule of law is the only way to do.
For this reason, this thesis first lays out the fundamental right of education as the constitutional basis of law-related education and teacher education and figures out their common purpose is the self-fulfillment of students. Also, the thesis tries to establish the specific contents of law-related education. Then, by the research of the primary and secondary school syllabus, the thesis could discuss the necessity of law-related education in teacher education. Finally, the thesis reviews the current status of law-related education in teacher education and establishes its substantial contents with corporal punishment issues in the hope of awakening educational competent authority to the respect for law-related education teacher, which will increase all the primary and secondary school teachers’ equipments of the rule of law and make them have the abilities to implement law-related education. In the end, a material rule-of-law state will become possible.
