社區大學作為終身學習與高等教育整合的法建構

Abstract

The article is for the vigorous new educational scenery in Taiwan’s society in recent years — Community University, during it did its original opinions and to practice its, we could see many problems and orientation issues and from these questions to strength with the conferring of fundamental rights, to find out the conditions of Community University, and how it will be in the future, there are three types could be conclude: First, according to the kernel of Article 22 of the Constitution “self-realization”, it was called “Lifelong Learning -Community University”. Second, “concurrent Lifelong Learning and Higher Education Community University” are blended by Article 22 and academic freedom fundamental right of Article 11 of the Constitution. Third, in the front of state “concurrent type”, if it could rub on each other continuously, I wish there are some Community Universities’ orientation could be the same with common universities and their kernel are academic freedom of Article 11 of the Constitution, but the function are different with “Adult-Higher Education organization”. The third type is my heartfelt hope for Community University. For example “Religion Research College” would become into the regular Higher Education, Community University also could turn towards the same way to strive, attain Knowledge Liberate and set up the opinion of Civil Society. Finally, the diverse style and features in Taiwan’s Higher Education will rely on this opportunity to make a stormy sea stormier.
