Abstract
When talked about sport in Taiwan, great emphasis has been put on sports science and recreation management rather than on laws. This dissertation provides the insights from law perspective, and constitutionally focuses on the issues that now and then affect our physical policies, as well as other regulations. Overall, the analysis is expected to meet human needs of all time.To begin, the paper dominates individual sport. Given illustration on how sport plays an important role on modern people of which developments and dilemma under the contemporary policy. As a result, on the basis of its importance, further discussion is given on constitutional protection aud guarantee to sport. Thus, there is bound to find out the basis of constitutional protection aud guarantee to sport first, it would be Article 22 of Constitution, with the result that “sport” should be one kind of the summed up right in Constitution. At the same time, the paper discussed, on the basis of fundamental right essence, what kind of effecf on the functions of subjective rights and objective laws been embodied in sport.
Behind the theoretical discussion, it is necessary to back to the practical issues. In order to solve the defects on the policies of physical education which caused development of physical education to fail in Taiwan. To deliberate about how to do more with sport for the people and what kind of effects could be provided by these private organization of physical education, the government should start to estabrish kinds of organizational aud systematical structure. Last part was going to discuss how to earn more resources for the people, at this point, to build bridges between society and schools with the sporting clubs is the most important, there will be a possibility to make these resources combine together. On this account, people could form a kind of sustainable development model with their own capability on sports.
