12年國民基本教育的憲法建構與檢討

Abstract

The implementation of the 9-year basic education for more than 40 years so far does have an important contribution to economic development. The society has high expectations on the extension of the basic education. Therefore, in 2014 the 12-year basic education will implement fully, and it can promote the basic education toward a new era. The program of the 12-year basic education involves the interests of the graduates of junior high school, so the way of implementation will become an important issue. First, the Constitution is prior; therefore this text will construct and review the 12-year basic education from the basic principles of the Constitution, which include the principle of rule of law and the principle of the social state. This text will construct and review the 12-year basic education from the fundamental right of education, and try to review the relative issues of the 12-year basic education from the self-realization.
