Some elements of the penalties for abstract dangerous offenders in the criminal regulations of food safety are unclear leading to the problem of excessive penalties In addition because criminal behaviors for the aforementioned criminal regulations are punishable by harsh penalties before they lead to unlawful consequences there is a tendency of giving out severer sentences This article discusses the legislative connotation of Article 49 Section 1 of the Food Security Law from modern criminal law and discusses the legislative suitability of this article from the theory of law interest and abstract dangerous offense theory and proposes amendments with reference to the laws of the United States and Japan
