Analyzing the Role of Offender’s Remorse in Capital Sentencing

Abstract

This analyzing is to discuss the issue: what is the meaning of offender’s remorse how can we find the justification of offender’s remorse in sentencing procedure and last how do judges in Taiwan recognize the offender’s remorse After analyzing the relative theories and judgments we can find that (1) Remorse is a backward-looking and forward-looking emotion which is suitable to be the core of attitudes after commission of offenses (2) The justification of offender’s remorse in sentencing procedure is not difficult to be found in different theories of criminal law but the practice of recognizing the remorse should be balanced with offender’s rights (3) After we realize the character and the definition of remorse we can find a better and more cautious way to rethink how judges deal with offender’s behaviors in capital cases
