According to the incomplete contract there are risks and the risk distribution of the contract must reach equilibrium otherwise it will cause obstacles to performance and will not help to achieve the purpose of the contract This article attempts to proposes the " Contractor’s rights equity partitioning theory " and the " Prohibition principle for the expansion of performance risk equivalents " as a qualitative and quantitative method to resolve the imbalance in contract risk allocation It is different from the traditional view that average risk must be distributed and has its scientific theoretical basis which can help to resolve the performance disputes
