Scenario Analysis of the Land Expropriation with Incremental Compensation -Case of Land Expropriation in Taichung Blue Line Mass Rapid Transit

Abstract

In Taiwan the existing land expropriation system which means that the government based on public interests to acquire the private land to set up public constructions Although the basis of compensations for land expropriation has been changed from an extra proportion of announced current land value to the normal transaction price the disputes over the compensations for land expropriation still come up incessantly However the difference in compensation for the landowners’ on property loss varies from person to person And the expectation of the incremental value of the surrounding land is not reflected in the normal transaction price Therefore the purpose of this study is to establish an incremental compensation for land expropriation which based on current regulations and in line with the principle of compensation of fair and effective land use and public interests In order to moderately eliminate the compensational price gap between the landowners' expected land value price and the of the normal transaction price This study conducted an empirical analysis of the Taichung Blue Line Mass Rapid Transit to examine the feasibility of incremental compensation According to the service level of public facilities around the case give each case a new floor area ratio which used for incremental compensation Convert the increased floor area of the increased floor volume as an incremental compensation floor area to the landowners whose land expropriated as a public facility In this way the landowners can obtain an opportunity for incremental land value in the future Following the financial plan of the case we adjust different situations such as the basic floor area ratio and the upper floor area ratio to calculate the incremental compensation floor area of each case Finally compared with the different scenario analysis of the original development plan to the development plan with incremental compensation It shows that the implementation of incremental compensation is still feasible And we try to make some feasible suggestions or proposals for the follow-up implementation
