Abstract

SUMMARY This study is aimed at researching the step-families a category of the non-traditional family From the professional point of the civil legal regulations using the research methods of documentary analysis comparative law and literature review This study would like to propose legislative loopholes and solutions of the step-families in Taiwan In the formation of the legal norms in step-families this article believes that we should discuss the role of step-parents as the status of “De Facto Parents” in order to avoid stigmatization and delaying the progress of legislative formation When adopting step-children according to the J Y Interpretation No 502 and the amendment of Art 1073 2 of the Civil law this article believes that in addition to the minimum age gap the maximum age gap should be amended The provision of Art 983 of the Civil law on the prohibition of marriage between step-siblings after adoption will be applicable depends on the case In addition to discussing the adjustment of the roles in the step-families formed by heterosexuality same-sex marriage after the passage of the “ the Enforcement Act of the Judicial Yuan Interpretation No 748 ”also has the possibility of forming a GL stepfamily；Except the GL stepfamily mentioned above this article will also introduce the step-families which formed by elderly parents who remarried and their adult children；the step-families relationship formed by several remarriages This article is aimed to provide a clearer picture of the legal development of step-families through the above discussion Key words：Step-Families Adoption GL Stepfamily
